Madrid court finds installation of LGTBI+ flags on City Council faction offices lawful
A Madrid court has confirmed the right of City Council factions to put LGTBI+ flags in their offices, dismissing the complaint by the Vox party.
Madrid Court No. 7 has dismissed the lawsuit brought by the Vox party and confirmed the right of the Más Madrid and PSOE factions to display LGTBI+ flags in their offices. The court stressed that these actions do not constitute the official position of the City Council, but concern the factions’ internal political activity.
The court also stated that displaying flags does not breach the principle of administrative neutrality and does not affect its impartiality. Furthermore, Vox’s political disagreement does not give it the right to challenge these initiatives in court.
Following the court’s decision, PSOE and Más Madrid representatives expressed their satisfaction. According to them, the ruling confirms the legality of the factions’ actions and the right to symbolic expressions in support of the LGTBI+ community’s rights and equality.
Thus, the judicial decision consolidates the principle that symbolic initiatives within the factions’ premises remain part of their political work and cannot be regarded as official decisions of the City Council.
